1. Legal Information
1.1. This website (the “Site”) is operated by Bresh International Operation LLC (“Bresh,” “we,” “us” or “our”), a company organized under the laws of the State of Delaware, United States, with registered address at 16192 Coastal Hwy, Lewes, Delaware, United States, 19958, EIN: 37-2148340, and a subsidiary of Bresh Global LLC.

2. Acceptance and Entire Agreement
2.1. Access to and use of the Site, together with its information, services and content, are subject to applicable law and to the provisions set forth in this Legal Notice, our Privacy Policy, our Cookie Policy, and any other policies and/or legal texts published on the Site (the “Site Policies”).
2.2. This document governs the general terms of use of the Site, which is of an exclusively informational nature and serves to showcase our business lines and brands. The Site does not process purchases, payments or user registrations. Please note that the purchase of tickets to Bresh events, where applicable, is carried out exclusively through third-party ticketing platforms (for example, ticketing platforms, venues or local promoters), and is governed by the terms of sale and policies of such third party, which are unrelated to Bresh.
2.3. Users of the Site (“Users”) acknowledge and agree that they have read and understood the Site Policies. The Site provides conspicuous and persistent notice of the Site Policies through a link accessible from every page of the Site (including, without limitation, the Site's footer), and, where applicable, through a cookie consent banner requiring an affirmative action by the User before non-essential Cookies are installed. By accessing or continuing to use the Site after such notice has been provided, the User expressly acknowledges and agrees to be bound by the Site Policies to the extent applicable. Users who do not agree to the Site Policies must discontinue their access to and use of the Site immediately.
2.4. The illegality, invalidity or unenforceability of any provision of the Site Policies shall not affect the enforceability of the remaining provisions. Such provisions shall be replaced or supplemented by others which, being lawful, fulfill the purpose of the provisions so replaced.
3. Amendment
3.1. Bresh reserves the right to amend the Site Policies at any time. Any material amendment shall take effect thirty (30) days after its publication on the Site. It is important that Users review the Site Policies periodically. Amendments shall not apply retroactively, except where required by law or where they benefit Users.
3.2. In the event of any discrepancy between the Site Policies and any prior version thereof, the Site Policies in force at the time of access shall prevail, unless otherwise indicated.
4. Use of the Site
4.1. Users undertake to use the Site in accordance with the law, morality, generally accepted good customs, public order and the Site Policies. In particular, Users undertake not to:
• Use the Site for unlawful purposes, for unauthorized commercial purposes, or to promote third-party products or services.
• Interfere with the operation of the Site, introduce viruses or other harmful components, or attempt to breach its security systems.
• Extract, copy or collect Site content in an automated manner (scraping, spidering, data mining), including for the development or training of artificial intelligence or machine learning tools.
• Impersonate Bresh, another User or a third party, or use the Site in a manner that suggests an unauthorized association with Bresh.
4.2. We reserve the right, at any time and without prior notice, to temporarily or permanently disable a User's access to the Site if, in our judgment, such User has breached any provision of the Site Policies or applicable law.
4.3. The Site's services do not include the network connection or the device required for its operation, which shall be the User's own responsibility to procure.
5. Content
5.1. The information and content on the Site are of a general and informational nature (including the showcasing of our business lines and events) and do not constitute legal or any other type of advice. We assume no obligation to continuously update or review such content.
5.2. The information and content on the Site do not constitute, and shall not be construed as, an offer, promise or commitment by Bresh to provide Users with any service or product. If a User is interested in attending a Bresh event, such attendance and the purchase of the corresponding ticket shall be governed by the terms of sale of the relevant third-party platform and venue or organizer.
6. Disclaimer of Liability
6.1. Bresh reserves the right to temporarily suspend the Site for technical, security or maintenance reasons, without this giving rise to any right to compensation on the part of the User.
6.2. Bresh reserves the right to implement changes and/or updates to the Site at any time, with or without prior notice, which may affect its accessibility.
6.3. THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, EXCEPT FOR THOSE THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
6.4. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRESH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SITE, THE INFORMATION CONTAINED THEREIN, OR ATTENDANCE AT A BRESH EVENT.
6.5. Bresh shall not be liable for any content, activities, products and/or services accessible through links to third-party sites (for example, ticketing platforms, social media or venues). The inclusion of such links does not imply any relationship, endorsement, invitation or recommendation regarding the site or content of such third party.
6.6. Bresh shall not be liable for transactions managed by third parties, nor for the acts or omissions of venues, local promoters or ticketing platforms. Each event may have additional requirements (age, identification, dress code, venue policies, among others) which shall be communicated by the organizer or the relevant sales platform, and which the User undertakes to comply with.
6.7. Framing of the Site or its content is prohibited.
7. Minors
7.1. Bresh is not responsible for the use minors make of the Site, nor for the disclosure of their personal data without the authorization of their parents or legal guardians, who are responsible for ensuring that minors under their care make safe use of the internet. We recommend installing parental control tools.
7.2. Bresh events may have their own age restrictions, which shall be communicated by the organizer or the relevant ticketing platform, and which the User undertakes to verify and comply with prior to attendance.
8. Intellectual and Industrial Property
8.1. The User acknowledges and agrees that all rights, title and interest in and to the Site, its content and software applications, including any modification, update and new version thereof, as well as any distinctive sign (whether registered or not), including the Bresh name and trademark, the slogan “la fiesta más linda del mundo,” logos, designs, photographs, videos, music and text, know-how, trade secrets and any other intellectual or industrial property rights inherent to the Site, are the exclusive property of Bresh Global LLC and/or its subsidiaries and licensors, including Bresh International Operation LLC, which uses them under authorization within the group, or are the property of third parties used by Bresh under license.
8.2. The User acknowledges that the mere use of the Site does not confer any intellectual or industrial property right upon the User. The total or partial reproduction, modification, transformation, copying, duplication, distribution, public communication, making available to the public, or any other form of exploitation of the Site, its content, design and “look and feel,” as well as its use to train, fine-tune or develop artificial intelligence or machine learning tools, models or systems, is prohibited without our prior written authorization.
8.3. Decompiling, reverse engineering or creating derivative works from the software supporting the operation of the Site is prohibited, except where expressly permitted by law.
8.4. Breach of any of these provisions shall entitle Bresh to pursue the legal remedies available to it in defense of its rights, including a claim for damages.
9. User-Generated Content
9.1. The Site and our social media may allow you to share photos, videos, comments, reviews or other content related to Bresh events and community (“User-Generated Content”). The User shall not post User-Generated Content that is unlawful, defamatory, discriminatory, violent, obscene, or that otherwise infringes the rights of third parties.
9.2. By posting or submitting User-Generated Content to us (including through tags, mentions or hashtags on social media, or by participating in Bresh contests or activations), the User grants us a worldwide, non-exclusive, transferable, sublicensable, royalty-free and irrevocable license to use, reproduce, adapt, publish, translate, distribute and display such content, in whole or in part, in any format or channel now known or hereafter devised, for purposes of marketing, promotion and communication of Bresh, with or without attribution, without any payment or further authorization being required.
9.3. The User represents that it holds the necessary rights over the User-Generated Content it shares and releases us from liability in connection with any third-party claims arising from such content.
10. Governing Law and Jurisdiction
10.1. The interpretation and application of the Site Policies shall be governed by the laws of the State of Delaware, United States, without giving effect to any conflict-of-laws principles.
10.2. Notwithstanding the foregoing, if the User is a consumer domiciled in Argentina, Spain, Mexico, Uruguay or any other country whose legislation grants such User non-waivable consumer rights, nothing in this clause is intended to deprive the User of the protection afforded by such mandatory rules, which shall prevail in the event of conflict. In particular, this clause does not restrict the User's right, where applicable under the law of the User's domicile, to bring proceedings before the courts of the User's habitual place of residence.
10.3. In the case of consumer Users domiciled in the European Union, should a matter not be resolved through the Site's support channels, Users are informed of the existence of alternative dispute resolution procedures for consumer disputes (ADR/ODR), available through the European Union's Online Dispute Resolution Platform or other competent bodies depending on the User's country of residence.
11. Accessibility
11.1. Bresh is committed to providing a Site that is accessible to the widest possible audience, including individuals with disabilities, and strives to observe applicable accessibility standards, including, to the extent applicable, the Web Content Accessibility Guidelines (WCAG) and EN 301 549.
11.2. Should a User encounter any accessibility barrier while using the Site, the User is encouraged to contact us at legalteam@bresh.com, indicating the nature of the issue and the relevant page, so that Bresh may review and, where appropriate, address it.
